Privacy Policy

This statement explains which personal data is processed when you visit this website, for what purpose, and what rights you have. It follows the revised Swiss Federal Act on Data Protection (FADP) and its ordinance (DPO). Where visitors from the EEA are concerned, the GDPR applies in addition.

In short: this website is a business card, not a data collector. There are no user accounts, no newsletter, no sale of data and no disclosure for advertising purposes.
 

1. Controller

Responsible for processing personal data on this website:

An informal message to that address is enough for any question about data protection.
 

2. What data is processed

Only data that the website needs in order to work, or that you enter yourself:

  • Technical access data that every web server logs (section 3).
  • What you type into the contact form, if you use it (section 4).
  • Usage statistics, if you have consented to audience measurement (section 6).
  • Your questions to the search assistant, if you use it (section 7).

No sensitive personal data within the meaning of Art. 5 lit. c FADP is processed. There is no automated individual decision-making and no profiling.
 

3. Server log files

Every time a page is requested, your browser transmits technically necessary information which the web server records:

  • IP address of the requesting device
  • date and time of the request
  • the address requested and the amount of data transferred
  • the status code of the response
  • browser and operating system identification (user agent) and the referring page

These logs serve operation, troubleshooting and defence against attacks. They are not combined with other sources and are not used to identify individuals. The legal basis is the overriding interest in operating the website securely and reliably (Art. 31 para. 1 FADP). Retention follows the hosting provider's settings and is usually a matter of weeks.

4. Contact form

The contact form asks for first name, surname, phone number, email address, subject and your message. First name, surname, email address, subject and message are required, because without them no reply is possible.

  • What happens with it: the entries are sent as an email to contact(at)marcelmarty.ch, and you receive a confirmation at the address you gave.
  • What does not happen: the entries are not stored in this website's database. The email is the end of it.
  • Spam protection: the form carries a technical check that recognises automated submissions. It evaluates how the form was submitted, not who you are.
  • Retention: correspondence is kept for as long as handling your enquiry and any statutory retention obligations require.

The legal basis is your own act of getting in touch, and with it the pre-contractual or contractual processing.
 

5. Cookies and consent

Simply visiting the website needs no cookies. What is set:

  • A cookie for your cookie decision, so the notice does not reappear on every visit.
  • A TYPO3 session cookie, where a function requires one, for instance when submitting the form.
  • Audience measurement cookies, but only after your consent (section 6).

You can change your decision at any time by deleting this website's cookies in your browser. The notice will then appear again.
 

6. Audience measurement with Matomo

Matomo, an open-source audience measurement tool, is used to improve the website.

  • Self-hosted: Matomo runs on this site's own infrastructure at marcelmarty.ch/analytics/. The data collected never leaves that infrastructure and is not passed to an analytics provider.
  • What is collected: pages viewed, time spent, links clicked, approximate region, referring page, device and browser.
  • Do Not Track is honoured: if your browser sends that signal, no measurement takes place.
  • Consent: measurement only starts once you have agreed in the cookie notice.

 

7. AI search assistant

This website offers an assistant that answers questions about its content. It is optional; nothing is transmitted unless you type something.

  • What is transmitted: the question you entered, together with the matching excerpts from this website's content.
  • To whom: to generate the answer, this is sent to Anthropic PBC, San Francisco, USA, whose language model powers the assistant.
  • Transfer abroad: this constitutes a disclosure to the United States. It relies on the standard contractual clauses and on the provider's undertaking not to use the input to train its models.
  • Please note: do not enter personal or confidential information into the assistant. For anything personal, the contact form or an email is the right way.

The legal basis is your consent, given by using the assistant.
 

8. Third-party resources

The icons on this website use a font file loaded from unpkg.com (Cloudflare, USA). In doing so that service learns your IP address, because it is technically required for delivery. No further data is transmitted and no cookies are set.

Fonts and every other resource are served from this site's own server. No Google services, no social media plugins and no advertising networks are embedded.
 

9. Links to other websites

This website links to third-party pages in several places, for instance to reference projects or profiles. Their content and their handling of personal data are the responsibility of whoever operates them. Following such a link takes you outside the scope of this statement.
 

10. Data security

The website is served exclusively over an encrypted connection (HTTPS with HSTS). Software and extensions are kept up to date. How to report a security vulnerability is described in the security policy.
 

11. Your rights

Within the limits of applicable law you have, in particular, the right to:

  • information about whether and which data concerning you is processed
  • rectification of inaccurate data
  • erasure or restriction of processing
  • withdrawal of consent with effect for the future
  • objection to processing based on an overriding interest
  • release or transfer of the data you provided yourself

A message to contact(at)marcelmarty.ch is enough to exercise these rights. Proof of identity may be required in order to protect them. If you are not satisfied with the answer, you may contact the Federal Data Protection and Information Commissioner (FDPIC) in Bern; visitors from the EEA may additionally contact their own supervisory authority.
 

12. Changes to this statement

This statement will be adjusted whenever the website or the legal situation changes. The version published here is the one that applies.
